Community Infrastructure Levy


Local Authorities have recently been given powers to raise a Community Infrastructure Levy (CIL).  This is a charge on new development that can be used to provide facilities and infrastructure.

The City Corporation will be preparing its own CIL, but is currently at an early stage in preparation.  The aim is to complete technical work, looking at infrastructure needs and development viability by June 2012, then to publish preliminary draft proposals for public consultation in September 2012 with draft proposals in early 2013 and a public examination of these later in the year.  The aim is to have a CIL in place by January 2014.  The CIL will form part of the Local Development Framework (LDF).  As development of the CIL is still at an early stage, we have not yet made any assessment of the potential scale of charge, nor the developments which will be subject to charge.

The CIL will operate alongside planning obligations, often known as S106 agreements and a revised Planning Obligations SPD will be prepared.  S106 agreements are attached to planning permissions that regulate the way development is undertaken.

The City Corporation's overall approach to planning contributions, including the CIL and S106 agreements, is set out in the LDF Core Strategy - see Policy CS4 "Planning Contributions" and Appendix 2 "Infrastructure Delivery Plan - Summary".

Until the adoption of the CIL, the City will continue to negotiate s.106 agreements in accordance with its   supplementary planning guidance "Planning Obligations" 2004.

The City will operate S106 agreements and then prepare the future CIL having regard to its  Infrastructure Delivery Plan.

Mayoral CIL

The Mayor of London is also introducing a Mayoral CIL on 1 April 2012 which will apply throughout Greater London, including the City. Visit the Mayor of London's website for further information.
